NACAPA is a nonprofit arts and cultural organization incorporated in California and based in Los Angeles. We operate the website nacapa.org and any associated subdomains. We are committed to protecting the privacy of our donors, volunteers, program participants, newsletter subscribers, and website visitors.

Information you provide directly:

When you donate, volunteer, subscribe to our newsletter, submit a contact form, or apply for a sponsorship or artist residency, we collect the information you provide — which may include your name, email address, phone number, mailing address, organizational affiliation, and payment information. Payments are processed securely through third-party payment processors. We do not store full payment card numbers on our servers.

Newsletter subscriptions: When you subscribe, we collect your first name, last name, and email address. Our self-hosted newsletter system may also record the IP address used to submit the form and operational records such as confirmation status, subscription and unsubscription activity, delivery status, and bounce history.

Information collected automatically:

When you visit nacapa.org, we may collect standard web analytics data including your IP address, browser type, pages visited, time spent on pages, and referring URLs. This data is used in aggregate to improve our website. We use cookies for essential site functions and, where you have consented, for analytics purposes.

3. How We Use Your Information

We use the information we collect to:

• Process donations and provide gift acknowledgments
• Communicate with donors, volunteers, and program participants
• Send our newsletter and event announcements to those who have subscribed
• Manage newsletter confirmations, subscriber preferences, delivery, bounces, and unsubscribes

4. Donor Records and Gift Acknowledgment

NACAPA maintains donor records — including name, address, and contribution amount — for organizational and recordkeeping purposes. These records are kept confidential and are not shared publicly.

As a federally recognized tax-exempt organization, NACAPA will provide written gift acknowledgments for qualifying contributions consistent with IRS requirements. For donations of $250 or more, a written acknowledgment is required for donor tax-substantiation purposes.

5. Third-Party Services

We use third-party services to operate our website and programs. Each service has its own privacy policy. Current services include:

• Hostinger — website hosting
• WordPress — content management
• Payment processor — for secure donation transactions. We do not store payment card data on our servers.
• phpList — self-hosted newsletter subscription and campaign management software operated on NACAPA’s Hostinger account
• Google Workspace — newsletter and transactional email delivery

We will update this list as our service providers change. We do not use Facebook Pixel, Google Ads conversion tracking, or behavioral advertising technology on nacapa.org, and we commit to updating this policy before adding any such technology.

6. Our Privacy Commitment to California Residents

NACAPA is a California nonprofit organization. While California’s Consumer Privacy Act (CCPA) generally does not apply to nonprofit organizations, we voluntarily commit to the following practices for all individuals, including California residents:

• We will tell you what personal information we hold about you if you ask
• We will delete your personal information upon request where we are not legally required to retain it
• We do not sell personal information — under any circumstances
• We will not treat you differently for making a privacy request

You may update or correct your newsletter information using the update-preferences link included in our emails or by contacting us at info@nacapa.org.

Our self-hosted newsletter system may record delivery information, opens or views, link selections, and bounces for operational and reporting purposes. NACAPA does not add Google Analytics or advertising tracking codes to newsletter campaigns.

9. Children’s Privacy

nacapa.org is not directed at children under 13. We do not knowingly collect personal information from children under 13 through this website without verifiable parental consent. Information collected in connection with our youth education programs is used solely for program administration and is collected with the consent of a parent or guardian.

10. Data Security

We implement reasonable technical and organizational measures to protect your personal information from unauthorized access, disclosure, or loss. Access to newsletter subscriber records is limited to authorized NACAPA administrators with an operational need. No internet transmission is completely secure, and we cannot guarantee absolute security of data transmitted to our site.
